(“Epic”). As I expect you know, Epic is a well-known Developer and publisher of videogames, and is the creator of the video game Fortnite, which has close to 250 million registered accounts across the world. Epic works hard to create, innovate and continually improve Fortnite to make it, and the experiences of those who play and watch it, as enjoyable as possible. One of the ways Epic Protects the integrity of Fortnite is to prevent scammers from unlawfully using Epic’s copyright-protected works to deceive members of the Fortnite community. Fortnite is the subject of U.S Copyright Registration Nos. TXu01-895-*64 (dated December 18, 2013 ), Tx008-186-254 (dated July 14,2015), TX008-254-659 (dated March 3,2016) TX008-352-178(dated December 23,2016) and Tx008-507-210 (dated March 21,2018) among others. These copyright registrations cover Fortnite’s computer code and the Audio-visual works and images that code generates. These copyrights are protected under the U.S. Copyright Act and International treaties that extend those rights to other countries. A Few weeks ago, Epic and Gumroad exchanged a number of emails about copyright infringement committed by Truebones and other sellers on Gumroad’s website at gumroad A copy of that email exchange is attached at Exhibit AUpon receiving Epic’s Initial email regarding this content, Cheryl, Manager of Support at Gumroad, “oh dear, that’s a lot of products.” See Exhibit A. We agree with Cheryl: it is a lot of products. Simply put, Gumroad is a wash in material that infringes Epic’s copyright in Fortnite and we demand that Gumroad act expeditiously to remove, or disable access to, the Infringing Materials. If Gumroad Fails to do so, Gumroad will not be able to avail itself of the DMCA’s safe-harbor provision, 2 and will be Liable for monetary damages as a result of its contributory infringement of Epic’s copyrights. For example, Gumroad has not provided contact information for a designated agent to the U.S Copyright Office as required by 17 U.S.C. ss 512©(2) . See also 37 C.F.R ss 201.38 (Any Service provider seeking to comply with section 512( c ) of the statute must: ( 1 ) Designate an agent…by providing to the Copyright Office, the service provider and designated agent information required by paragraph (b) of this section…”)Mr Shahil Lavingia Gumroad, Inc September 12 , 2019 page 2PPab 5110664v2, This letter is a follow up on that email exchange and puts you on notice under the Digital Millennium Copyright Act (“DMCA”) 1 that the content at the following links on Gumroad’s website( the “Infringing Materials” ) Infringes Epic’s Above-Identified copyrighted works:
Ordered my book over 3 months ago and still not received.Update (11-12-21): I just received a response from my review to say I may request a refund. However, after numerous emails, someone actually responded and sent my books. I received them just short of 7 months after I ordered. I've seen several videos with the author of the book I ordered, signing many pages on copies that were to be sent out. Did I receive a copy with one signature, anywhere? No. So, here is my updated review. Sour perhaps, but it stands. I may have temporarily been reminded. Once I delete the email I was sent to edit my review I'll be over it. Being happy is the ticket out of this realm. Cheers~
This website is an utter SCAM! They let me as a creator in and all of a sudden they filed multiple chargebacks against my account and they eventually withdraw all my earnings for themselves! Not googling them before creating an account was my mistake in the first place, so BE CAREFUL FOLK!
I made my first sale for a logo last week and have had my account suspended with no reason as to why.My profile has been deleted and I'm clearly not getting the money for the sale. Im absolutely fuming and gumroad doesn't seem to have any live-support to speak to as their twitter and facebook doesn't accept messages - convenient... Please do not use gumroad, I thought all of these poor reviews were fake haters. Sadly I now know the truth its a con.
From a digital seller standpoint: I had been selling my family friendly digital items on payloadz for years. I was getting charged 12 bucks per month and never made that amount per month on my products. Someone suggested gumroad which is not only free, but also a more family oriented platform to sell my products. Easy platform to learn how to add digital products and now I can focus more on adding my products without paying monthly fees. Plus, you can download up to 16gb per product (a huge plus), and again, more family friendly platform (as I saw some nude/and adult oriented products on payloadz, but not on gumroads. Lastly, you can also sell via all major credit cards, not just PayPal. I will update my feedback when I start getting sales to let you know if I have had any issues. I do not have any review for buying on gumroad, so I cannot review that part of the platform.
I've been a creator for years with Gumroad. They have always helped me achieve my goals. I am happy to pay them what they charge because they've allowed me to focus on creating. Everything is so streamlined on their site! It's so simple to use. I'm not terrific with technology and I was able to create slick sales sites with their software.Their support staff has always been super helpful with me as well. Every time I have a question they give me great informative responses that have helped me expand my reach. Highly recommended.
Gumroad misses a lot of features, which would make their platform more user-friendly and overall attractive to potential users. Once your country is eligible for Stripe payouts, you are forced to use this form. You are also forced to have your bank account set up in your country, which is just unreal for a lot of people e.g. digital nomads, full-time travelers. Their customer service can be unhelpful and unfriendly at times. Their "we're here to make money" and "time costs money" attitude towards potential clients is repulsive. With the rise of similar platforms, this attitude and the lack of payout options could mean the end for Gumroad.
Contrary to most of the negative reviews here, I've never had a problem with Gumroad. Most of the negatives given on Trustpilot are the fault of individual creators using the platform, not that of Gumroad. The site is great, and I highly recommend it.
They are a partner in running a scam with Forexroad.net, they are collecting money from clients for Forexroad and never providing any actual services, I have reached out to their help line but they were of no help in providing me refund, Do not use their services, you will loss money.
