I, like 4,000 others were scammed into backing Vinyl Sonic. A product that had no intention of ever coming to fruition. A total of over $600k was scammed from backers with Kickstarter banking their 15% commission.However when it became clear that the product developers had no intention of producing a product, Kickstarter didn't want to know. When I claimed a chargeback against my bank card, Kickstarter fought the case referring to their terms and conditions as them acting simply as a platform with no contractual liability and that they did not offer refunds. There is a difference between a refund and a chargeback claim.I am one of the lucky ones. I fought their response and successfully claimed a chargeback. Here is the basis on which I won my case:1. Kickstarter will not release the business details of the product developer making it impossible to claim against that company.2. Chargeback can only be against the original company who debited the funds i.e. Kickstarter.3. They have a clause in their terms and conditions with the product developer which states that if a chargeback is successful, they will debit the credit card of the advertiser. In other words, they have a mechanism to recover their losses on a chargeback.This term shows that Kickstarter are fully expecting chargebacks and have included a term to recover the funds for successful chargebacks from the advertiser by debiting the advertiser’s credit card. This is because the only company that chargebacks can be initiated against is Kickstarter themselves. They were the only party to enter into a financial transaction with the buyer and are the only organisation who can recover funds from the original advertiser, as they do not publish developer's details meaning this option is not open to the buyer.When I furnished my bank with this information, my chargeback was upheld and I secured a full refund. Once this happened, Kickstarter removed me as a backer, meaning I could no longer post comments on the product page and explain to others how they could fight Kickstarter's refusal of chargebacks. Very unethical.I hope this can help others who have fallen victim of the numerous scams posted on this site, from which Kickstarter are making a substantial financial gain.
