Suitcase damaged, refund refused

My suitcase was lost, and returned to me a few days later damaged and covered in writing (from a black marker pen). The suitcase was brand new, and this was the first time it had been used. Emirates will not refund this as the bag is technically functional. The writing is large, on both sides of the suitcase, and will not come off with cleaning products or acetone. This is evident damage caused by the airline, and Emirates will not take accountability.
