Waiting over a month for Refund

Purchased a Roku Device on 2/16 for delivery on 2/17. It never arrived and a month later I still have not received a refund. Support is useless, filed a complaint with BBB, will be filing court action if BBB can't help get my refund. Was told it was damaged during delivery, not my problem. Horrible company will no longer use for anything.
